1. Introduction

By accessing or using the AR Drawing - DoodleTop mobile application ("App") on Android or iOS, users agree to be bound by these Terms and Conditions. If users do not agree, please refrain from using the App.

2. Privacy Policy

AR Drawing - DoodleTop is committed to protecting user privacy. We collect minimal personal data necessary for user authentication and subscription management. No personal data is sold or shared with third parties.

3. User Permissions

To fully utilize the App's features, the following permissions may be requested:

• Camera Access: Used exclusively for AR Drawing features.
• Gallery Access: Enables image import for editing and drawing. Images are used locally and never uploaded.

Users may grant or revoke these permissions at any time via their device settings.

4. Intellectual Property

All rights to the app's code, UI, features, and branding belong to AR Drawing - DoodleTop and are protected under applicable intellectual property laws.

• Users retain rights to original artworks they create using the app.
• Copying, modifying, reverse engineering, or redistributing the app without permission is strictly prohibited and will be held accountable.

5. AI Image Generation Feature

5.1 How It Works

AR Drawing - DoodleTop includes an AI-powered image generation feature that allows users to generate reference photos for drawing and tracing. When a user submits a text prompt, it is first processed and enhanced by Google Gemini to improve the quality and relevance of the output. The modified prompt is then passed to Google Cloud Vertex AI Imagen to generate the final image. By using this feature, the user acknowledges that the original prompt may be altered before image generation, and that the modified prompt is what is processed and sent to the image generation model.

5.2 AI-Generated Content – Ownership and Use

• AI-generated images are produced algorithmically and are not intentionally based on any specific copyrighted artwork.
• Images generated within the app are intended for personal and creative use, primarily as drawing or tracing references within the app.
• Users may use generated images for personal and non-commercial creative projects. Commercial redistribution of AI-generated images outside the app is beyond DoodleTop's legal liability and may require additional scrutiny.
• AR Drawing - DoodleTop makes no warranty that AI-generated images are free from third-party intellectual property claims. Users are responsible for how they use generated contents outside the application.

5.3 Prohibited Prompts

All prompts submitted to the AI image generation feature are subject to automated content moderation. The following categories of content are strictly prohibited. This list is illustrative and not exhaustive — any prompt that our system or team determines to be harmful, inappropriate, or abusive may be rejected:

• Sexual and explicit content – Any sexually explicit, suggestive, or adult content of any kind, including nudity.
• Drug-related content – Depictions or promotion of illegal drugs, narcotics, or controlled substances.
• Violence and graphic imagery – Gore, graphic violence, self-harm, suicide, or content that glorifies harm to any person or animal.
• Hate speech and discrimination – Content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or any other characteristic.
• Content harmful to minors – Any content that exploits, sexualises, endangers, or is otherwise harmful to children.
• Weapons – Realistic depictions of firearms, explosives, or other dangerous weapons.
• Real people and public figures – Realistic depictions of real, identifiable individuals, including celebrities, politicians, or public figures, without clear satirical or editorial context.
• Copyrighted and trademarked characters – Characters, logos, or imagery protected by intellectual property rights (e.g. Disney, Marvel, Nintendo).
• Political and religious extremism – Content promoting extremist ideologies, terrorist organisations, or incitement to violence.
• Misinformation – Content designed to mislead, deceive, or spread false information.
• Prompt engineering and jailbreaking – Any attempt to manipulate, bypass, or override the AI system's content filters through prompt injection, indirect wording, roleplay framing, encoded instructions, or any other technique designed to extract prohibited content or circumvent our moderation systems. Such attempts are treated as violations regardless of the final output.

We reserve the right to update this list at any time as our moderation policies evolve.

5.4 Violation Penalty

Submitting a prompt that violates our content guidelines will result in the prompt being rejected. Token deductions apply as follows:

• Tokens are not deducted for generation failures caused by technical errors or server issues.
• On every 5th content violation attempt (i.e. the 5th, 10th, 15th, and so on), 50 tokens will be automatically deducted from the user's account balance as a penalty.
• This penalty applies regardless of whether the violation was intentional.
• Repeated or severe violations may result in suspension or permanent termination of the user's account, with forfeiture of any remaining token balance.

5.5 AI Content Disclaimer

AI-generated images are produced by machine learning models and may occasionally produce unexpected, inaccurate, or imperfect results. AR Drawing - DoodleTop does not guarantee the quality, accuracy, or suitability of any AI-generated image for any specific purpose. All AI-generated content is provided "as is" without warranty of any kind.

5.6 User Responsibility and Exclusion of Liability

All use of the AI image generation feature is entirely at the user's own risk. While we make reasonable efforts to moderate content and prevent the generation of infringing, harmful, or inappropriate material, we cannot guarantee that our moderation systems will intercept every possible violation. If a user deliberately or inadvertently finds a way to generate content that infringes third-party intellectual property rights, violates applicable laws, or breaches these Terms, full legal and moral responsibility for that content lies solely with the user. AR Drawing - DoodleTop, Aqua Wave App, and their operators expressly disclaim any liability arising from such content or its use.

6. Third-Party Services

To improve performance and reliability, AR Drawing - DoodleTop integrates with the following third-party services:

• Firebase Analytics – App usage analysis.
• Firebase Crashlytics – Crash detection and resolution.
• Firebase Realtime Database – Sync and manage app-related data.
• Firebase Authentication – Secure sign-in management.
• Google Cloud / Vertex AI & related Google AI services – Where you use AI image generation, prompts and related data are processed for moderation and image creation under Google’s terms and safety settings applicable to those services.
• Google Play Billing – Manage subscriptions on Android.
• Apple App Store / StoreKit – Manage subscriptions on iOS.
• Apple Sign-In – Secure sign-in management on iOS (where available).
• Google Gemini – AI-powered prompt enhancement prior to image generation.
• Google Cloud Vertex AI (Imagen) – AI image generation. Prompts are transmitted securely to Google's infrastructure for processing and governed by Google's Cloud Privacy Notice and Terms of Service.

These services may collect anonymized, non-personal data for analytics and stability. For AI image generation, text you enter in prompts is sent for processing as described in Section 5; do not include sensitive personal data in prompts unless you accept that risk. Other app areas follow our Privacy Policy regarding account and subscription data.

7. Subscriptions, Tokens & Pricing

AR Drawing - DoodleTop offers optional premium features through subscriptions and token packages available on the Google Play Store and the Apple App Store.

7.1 Subscriptions

• All subscription payments are processed by Google Play Billing (Android) or Apple's App Store / StoreKit (iOS). We do not directly handle or store the user's payment information.
• Subscription auto-renewal and cancellation are managed through the respective platform's account settings.
• Refund requests for subscriptions are subject to the refund policies of Google Play or Apple App Store, as applicable.

7.2 Token Purchases

Tokens are a virtual in-app currency used to access the AI image generation feature. Tokens have no real-world monetary value and cannot be transferred, exchanged, or redeemed for cash.

• Tokens are purchased as consumable in-app purchases through Google Play Billing (Android) or Apple's App Store / StoreKit (iOS).
• All token purchases are final and non-refundable. Once purchased, tokens cannot be refunded, exchanged, or transferred under any circumstances, including accidental purchases, unused balances, account suspension or termination, or tokens deducted as a violation penalty.
• Tokens are not deducted for generation failures caused by technical errors or server issues.
• Token balances are forfeited upon account deletion or termination and cannot be recovered.

7.3 Token Expiry

Purchased tokens do not expire as long as the user's account remains active and in good standing. We reserve the right to introduce token expiry policies in the future, and any such changes will be communicated to users in advance via the app or our website.

7.4 Pricing Changes

We reserve the right to update, change, or discontinue pricing for any and all offerings at any time and without prior notice. This includes but is not limited to subscription tiers, token packages, free tier allowances, and any other paid or promotional feature within the App. Price changes will apply to new purchases or the next billing cycle after the change takes effect and will not retroactively alter an already-active subscription period or already-purchased token balance.

8. Exclusion of Liability

To the fullest extent permitted by applicable law, AR Drawing - DoodleTop, Aqua Wave App, and their respective operators, directors, employees, and agents expressly disclaim all liability arising from or in connection with the use of the App, the AI image generation feature, and any content generated through it. This includes, without limitation:

• AI-generated content – We are not liable for the accuracy, quality, legality, or suitability of any AI-generated image. All use of AI-generated content is entirely at the user's own risk.
• Intellectual property – While we make reasonable efforts to moderate content and prevent the generation of material that infringes third-party intellectual property rights, we cannot guarantee that every generated image is free from such claims. If a user finds or exploits a way to generate infringing content, all resulting legal liability rests solely with that user.
• Moderation bypass – If a user deliberately or inadvertently circumvents our content moderation systems to generate prohibited content, full legal, moral, and financial responsibility for that content lies solely with the user. AR Drawing - DoodleTop expressly disclaims any liability arising from such content or its subsequent use.
• Third-party services – We are not liable for the actions, policies, or availability of third-party services integrated within the App, including but not limited to Google, Apple, and Firebase.
• Loss of tokens – We are not liable for any loss of tokens resulting from account termination, violation penalties, or technical issues beyond our reasonable control.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under Irish law.

9. Limitation of Liability

• The App is provided "as is" without any warranties, express or implied.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App.
• We are not responsible for the content, quality, or accuracy of AI-generated images, nor for any consequences arising from the use of such images inside or outside the App.
• We make reasonable efforts to moderate AI-generated content and prevent intellectual property infringement, but we do not guarantee that all generated content is free from third-party claims. Any liability arising from AI-generated content that infringes third-party rights rests solely with the user.
• Users are responsible for ensuring their device compatibility and app usage.

10. Child Safety

AR Drawing - DoodleTop is open to users of all ages. To ensure a safe experience for everyone, including minors, we enforce strict content moderation on all AI-generated content. Our systems are designed to prevent the generation of any content that is sexual, violent, harmful, or otherwise inappropriate.

Parents and guardians are encouraged to supervise their children's use of in-app purchases, including token purchases, and to enable parental controls through their device or the respective app store to manage and restrict purchases.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.

12. Changes to Terms

We may update these Terms and Conditions from time to time. Updates will be made available in the app or on our website. Continued use of the App after any changes constitutes acceptance of the revised Terms.
